Senator Marshall Introduces Legislation to Restore Sanity to our Passport System

Washington – On Wednesday, U.S. Senator Roger Marshall, M.D. (R-Kansas), introduced the Passport Sanity Act, a bill to support President Trump and Secretary Rubio’s efforts to ground passports and other State Department documents in biological reality.

This legislation would prohibit the Secretary of State from issuing a passport, passport card, or consular report of birth abroad that includes the unspecified (X) gender designation and require applications for these documents to include only the designations of male or female.

“Passports play a critical role in safeguarding our national security by confirming the true identity of individuals leaving and returning to the U.S. — which is why they must reflect factual, biological reality,” said Senator Marshall. “Congress should act quickly to enshrine the Passport Sanity Act into law, reinforcing the common-sense approach championed by President Trump and Secretary Rubio.”

“Passports protect national security by verifying the identity of individuals exiting and reentering our country,” said Senator Blackburn. “Radical gender ideology ignores biological reality, and the Passport Sanity Act would restore common sense to the passport system by ensuring U.S. passports accurately reflect the holder’s sex.”

Background:

  • In 2022, President Biden created gender identity-friendly passports, allowing Americans to select male, female, or X. The “X” designation was intended to allow for “identifying as non-binary, intersex, and/or gender non-conforming.”
  • Earlier this year, President Trump reversed this with an executive order, returning passports to “accurately reflect the holder’s sex.”
  • Lower courts have ruled against the President, stating that the Administration’s goal of having a consistent definition of sex across government doesn’t meet the appropriate standard to reverse the current status quo.
  • On FridaySeptember 19, President Trump asked the Supreme Court to block lower court rulings requiring him to issue passports conforming to this radical, leftwing gender ideology.
