Senator Marshall Reintroduces Open Borders Invasion Resolution

Washington, D.C. – Today, U.S. Senator Roger Marshall, M.D. reintroduced his resolution that officially declares the crisis at the southern border an invasion as defined by the United States Constitution. 

This resolution recognizes each state’s right to secure their border themselves. Senator Marshall originally introduced this resolution in August of 2022. Currently, the U.S. faces a historic and worsening border crisis. As a consequence of our open borders, Fentanyl is flowing into our communities and killing 300 Americans a day. 

“Over 6 million migrants have crossed our southern border under Joe Biden’s watch; that’s more than double the population of the entire state of Kansas. Chinese military-aged men with ties to the CCP, cartel drug dealers, and people on the terrorist watchlist are among the millions exploiting our border vulnerabilities,” Senator Marshall said. “This is our nation’s most immediate national security threat, yet Joe Biden refuses to do anything to stop this invasion at our southern border. Since our own Commander-in-Chief won’t stop this historic crisis, an invasion declaration, as defined by the U.S. The Constitution allows Congress to recognize each state’s right to secure their borders themselves,” Senator Marshall said. 

“The work that Sen. Marshall and his staff have done to elevate and identify dormant constitutional authorities that would help address the border crisis is true leadership. Our border is on fire and the present conditions that empowers cartels to have operational control of our border and fuels the movement of international terrorists, and victims of human trafficking, across our borders is an invasion and it is subjecting Americans and our communities to imminent dangers. As such, Article I, Section 10, Clause 3 is absolutely relevant and should be utilized as part of the path forward to securing the border and recognizing the authority of states to protect their own communities,” Wade Miller, Executive Director, Center for Renewing America said.
